By using our website, you are accepting our terms and conditions and that you agree to abide by them and to use our service only for lawful purposes.

Information about us

CashLady.com is a website operated by Money Gap Group Limited trading as CashLady (“We, Our, Us”). We are a limited company registered in England and Wales with Company No. 6617413 and having our registered office at 28-32 Wellington Road, London NW8 9SP. Our VAT number is 940771518.

We are authorised and regulated by the Financial Conduct Authority. We are registered under the Data Protection Act 1998 with Data Protection No: Z1696368.


The CashLady service

CashLady.com is a credit broker and provide the service of introducing our clients to lenders in the short term consumer credit industry.

We provide a number of services via telephone, online applications and other means. By making an application on this website or by telephone through our customer service team you are also entering into an agreement with us.

We do not provide loans or finance and do not represent the interests of or act on behalf of any individual lender or financier. By applying with us you consent to us sending your application to the lenders we work with so they can review your application for credit. The Lenders we work with will analyse your application for credit and will conduct a form of credit worthiness assessment and affordability assessment based on the details you have submitted. In assessing your application it is likely the lender will send your application to a credit reference agency to conduct a credit check. Please note that applications for high cost short term credit may have adverse effects on your credit score and this can limit your access to other forms of credit in the future. By submitting this application you are accepting that a record of your application may be recorded and kept on your credit file.

The lenders we work with are also likely to conduct a fraud check with a fraud prevention agency and an identity verification check. In submitting your application you consent to the lenders we work with sending your details to third parties agencies to conduct the necessary checks.

If you are successful in your application for credit, you will receive an email from the lender with a provisional offer that you are not obligated to accept. We recommend that you read the credit agreement and accompanying documentation fully before signing the credit agreement.

While we do not charge you for making an application for credit through any of our websites, we do receive a commission from the lenders directly if your application for credit is successful. The commission we receive from each lender may vary. Due to the arrangements we have with certain lenders, we may show your application to certain lenders as a matter of preference.

While we do not provide you with credit directly ourselves, we may conduct a soft credit check or identity verification check to enable us consider if the product you are applying for is suitable for your needs. If we consider the product is unsuitable for your needs we may introduce you to providers of alternative products that we consider may be more suitable to your needs. Please note that this does not constitute financial advice and if you are in need of financial advice you should contact an Independent Financial Adviser.

The information you provide must always be true and accurate, as misleading information will be regarded as a breach of our terms and is likely to breach any agreement the client has entered into with the lenders and financiers we work alongside. Furthermore, misleading information may also result in the instigation of criminal procedures against the client.

By entering into an agreement with us you are accepting our terms and conditions relating to the agreement and also are agreeing to abide by them and be bound by them.

We acknowledge our obligations to this agreement by performing the service you have requested. In doing so we are the service provider and you are our client.

We deal directly with the client and have no obligation to any party other than our client. If you are accessing our service on behalf of a third party our obligation is still with you, the client. And as our client the terms and conditions of this agreement apply to you, the client and no other parties or agents connected to you. If you wish for a third party to represent you in your correspondence or dealings with us, we will require proof of your authorisation to represent you from the third party. This is so that we can ensure we are not disclosing your details to a party you have not authorised.


Service Limits

If the client has authorised any third parties to access the service on behalf of the client instructions issued by authorised third parties will be contractually binding on the client on whose behalf the third party is acting.

Should the client choose to make a joint application for a loan or finance via our site each party will be dealt with as a client acting with the consent of the other and if correspondence is entered into with one party of the joint application it shall be assumed that the communication is with both parties.

Once a client enters into an agreement with us and accepts our terms and conditions, we act as the client’s broker for a period of 6 months. This period allows us the chance to try and find a loan or offer of finance required by the client.

We do not provide loans or finance therefore we do not set or exert any influence over the rates of interest charged for financial products. Interest rates are set by the lenders and financiers who will also make the decision as to the provision of loans of finance to our clients.

The costs and rates included on our website are included by way of example and should not be read as indicative of the rate or cost of the loan you may obtain from a lender we work with. It will be the client’s responsibility to check any of the terms of any loan Agreement the client may agree with a lender.

The decision to provide clients with loans or offers of finance lies with the lenders and financiers alone and will depend on many things including a lender’s assessment of a client’s credit history, and an affordability assessment based on the information provided by you in the Application Form.


Accessing and using our website

Access to our website is permitted on a temporary basis, and, as explained below, we reserve the right to withdraw or amend the service we provide on our website without notice. We will not be liable if for any reason our website is unavailable at any time or for any period.

From time to time, we may restrict access to some parts of our website, or our entire website, to users who have registered or applied with us.

If you choose, or you are provided with, a user identification code, password or any other piece of information as part of our security procedures, you must treat such information as confidential, and you must not disclose it to any third party. We have the right to disable any user identification code or password, whether chosen by you or allocated by us, at any time, if in our opinion you have failed to comply with any of the provisions of these terms and conditions.

We will assume until told otherwise that the client agrees to us using telephone, SMS, email, fax and post to alert the client to products and services related to us and our associated companies. Unless you opt out of future marketing campaigns when you apply with us, we may follow up your application with a courtesy call from one of our Customer Services team to see how you found the process and to offer any further assistance if required.


Exclusions

The obligations and responsibilities of any breach of contract of or by us does not extend beyond the agreement with the client and does not include any obligation to any bank, counterparty, intermediary or other third party connected to the client.

The client takes full responsibility for any loss or damage incurred through the provision of misleading or incorrect information to us by the client.

Should loss arise from our non-performance there will be no liability held against us if this is caused by something beyond our reasonable control, including changes in the law or regulations affecting our normal operations.

Apart from provisions expressly covering associate companies, nothing in these terms is enforceable by anyone who is not a party to them.


Information about you and your visits to our website

We process information about you in accordance with our Privacy Policy. By using our website, you consent to such processing and you warrant that all data provided by you is accurate.
